High Court declines to modify stay order on GO 123

The Hyderabad High Court on Tuesday said that it would give quietus to the vexatious issue of challenge to the land acquisition process taken up by the Telangana government through GO Ms 123 which contemplated payment of money to land owners through negotiation and giving the go-by to new the Land Acquisition Act of 2013.
It said it was not inclined to modify the earlier order of staying the purchase of lands through GO 123.
A division bench of the Hyderabad High Court comprising Acting Chief Justice Ramesh Ranganathan and Justice Shameem Akther on Tuesday declared that it would hear all the cases filed challenging GO 123. The bench was dealing with a request of the State government which maintained that it had incorporated all the benefits given to landless poor under Act of 2013 and therefore it should be permitted to pursue the acquisition under GO Ms 123.
The bench reminded that it had passed a 90-page judgment in interlocutory stage and now it was not proper for another round of argument on an interlocutory application. It wanted to hear all the cases filed in this regard finally. The cases would be listed on Monday and the final arguments begin. The case filed regarding non-fixation of market value prior to notification under the 2013 Act will also be listed.
