Tripura HC orders provision of parking in building plan compulsory

A landmark order was passed by a division bench of the high court comprising chief justice Sanjay Karol and justice Arindam Lodh.

In the order, the Tripura high court mandates compulsory provision for parking in the plan of building before the same is sanction by Agartala Municipal Council (AMC).

The division bench of the high court has also directed the chief secretary of the state to file an affidavit in this regard within next two days.

The order passed is a result of a public interest litigation (PIL) filed on March this year by Kaushik Nath. The PIL was filed to seek the High Court’s direction to clear the roads and streets of Agartala from encroachers, illegal shops and stall runners.

The high court ordered the AMC authority to strictly adhere to the provisions of Building Rules-2017 before sanctioning permission for new buildings.

The order also directed the AMC authority to keep mandatory provision for parking by the applicant for new constructions before sanctioning permission for the same.

Chief justice Sanjay Karol said that from now on provision for parking has been made compulsory before granting permission for buildings to be constructed on more than 70 square metres of land.
