Opposing the bail application filed by an accused in a rape case, the victim told the Sessions Court that she had undergone as many as 12 abortions after the accused had forced himself on her. Taking cognisance of the alleged crime, which began ten years ago and went on till April 2017, the court rejected the accused’s bail application.
While passing its verdict, the court held that the FIR copy clearly stated that the accused had physical relations with the victim and had forced her to opt for abortions against her consent.
The accused, Nilesh Shinde(28), a Jogeshwari resident, befriended the victim in 2008 and later influenced her into entering into a physical relationship on the pretext of getting married. The victim is 10 years older than him and already has two children.
The victim alleged that she got pregnant on 12 occasions, and that every time, Shinde gave her pills and aborted the foetus against her will. She alleged that in 2013, he had assaulted her and caused an injury to her kidney, and thus a case of assault was registered against him. After this incident too, he met the woman and continued to force himself on her, she alleged.
As per the FIR, this year, when the accused was about to get married, Shinde’s family allegedly threw chilly powder in the victim’s eyes and tore her clothes as a warning to stop her from wrecking his marriage. The bail order passed by the court says that medical evidence proves such an assault took place.
Finally, the victim decided to raise her voice and registered a complaint of rape against Shinde.
He, however, claims that he has been falsely implicated in the case
